Terms of Sale

1. Interpretation

  1. In these Conditions:

    "Buyer" refers to the individual who makes purchases of Goods on the Platform.

    "Conditions" mean these Terms and Conditions of Sale.

    "Contract" means the agreement formed when Seller accepts the order placed by Buyer on the Platform for the purchase of Goods.

    "Goods," also referred to as "product," are the items available for sale on the LOOTZ Platform, including any parts or components.

    "LOOTZ" refers to LOOTZ SDN. BHD. (Formerly known as TECHVORTEX SDN. BHD., Company No.: 202301013006 (1506928-W)), a company incorporated in Malaysia.

    "Platform" means the LOOTZ web and/or mobile application.

    "Services" means the use of any services, information, and functions provided by LOOTZ on the Platform.

2. Orders and Specifications

  1. The Buyer can purchase Goods by completing the order form on the LOOTZ Platform, ensuring order accuracy. Each accepted order creates a separate Contract, becoming irrevocable and unconditional upon transmission through the Platform. LOOTZ is entitled (but not obliged) to process such orders without further consent from the Buyer.
  2. LOOTZ reserves the right to refuse or cancel orders without providing reasons before confirming dispatch. LOOTZ may also request Buyer's verification information, including address and contact numbers, before confirming dispatch.
  3. Modifying or canceling a concluded Contract requires prior written consent from LOOTZ. The Buyer must indemnify LOOTZ against all losses, costs, damages, and expenses resulting from such modifications or cancellations.

3. Price

  1. Goods' prices are those stated on the Platform when the Buyer places and completes the order form. The price includes applicable taxes but excludes the delivery fee.
  2. If a Goods' price is misstated on the Platform, LOOTZ can terminate the Contract. The Buyer will receive notification of cancellation through email or the LOOTZ mobile application. This termination right remains even if Goods have been dispatched, are in transit, or payment has been charged.
  3. Prices for our products are subject to change without notice.
  4. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
  5. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

4. Terms of Payment

  1. The Buyer can make payment for Goods using various payment methods available on the LOOTZ Platform.
  2. Terms and conditions specific to each payment method, as specified by LOOTZ on the Platform, apply to the Contract. The payment method may also be subject to the following terms:
    1. Online Banking: The Buyer transfers the total purchase price (including applicable taxes, fees, and shipping costs) to a LOOTZ account. This transaction must be payable in Ringgit Malaysia. LOOTZ reserves the right to refuse this payment method for any reason.
    2. E-Wallets: LOOTZ accepts Touch'n Go eWallet payment method.
  3. You acknowledge that your content, excluding credit card information, may be sent without encryption and may undergo (a) transmission across different networks, and (b) adjustments to meet the technical needs of connecting networks or devices. However, please note that credit card information is always securely encrypted when transferred over networks.

5. Delivery / Performance

  1. Goods are delivered to the address specified in the Buyer's order. The Buyer cannot choose the delivery time.
  2. Delivery dates provided are approximate, and delays may occur. The time for delivery/performance is not essential, and LOOTZ is not liable for any delivery delays.
  3. All confirmed orders will be delivered within an estimated time of arrival (ETA) of 14 days from the date of purchase.
  4. The ETA includes public holidays and is applicable for the entire Malaysia region.

6. Return of Goods

  1. The Buyer can request a return of purchased Goods under the following circumstances:
    1. Goods delivered are defective and/or damaged on delivery.
    2. Goods delivered do not match the agreed specifications in the order.

7. Risk of and Property in the Goods

  1. Risk of damage or loss of Goods passes to the Buyer upon delivery or, if the Buyer fails to take delivery, when LOOTZ tenders delivery.
  2. The Buyer agrees to notify LOOTZ promptly of any matters affecting LOOTZ's title to the Goods. The Buyer will provide necessary information as requested by LOOTZ.
  3. Until the property in the Goods passes to the Buyer, LOOTZ is entitled to demand the Buyer deliver the Goods. Failure to comply gives LOOTZ the right to take legal action and seek damages, including legal fees, from the Buyer.
  4. The Buyer indemnifies LOOTZ against losses, damages, costs, expenses, and legal fees incurred by LOOTZ related to the assertion and enforcement of rights under this clause.

8. Warranty and Returns

  1. LOOTZ's warranty concerning Goods is subject to specific conditions:
    1. No implied warranty is made concerning Goods' life, wear, suitability for specific purposes, or conditions.
    2. LOOTZ is not liable for any loss, damage, or liability suffered by third parties due to unauthorized repairs or remedial work without LOOTZ's written approval. The Buyer indemnifies LOOTZ for losses arising from such claims.
  2. Defective or damaged Goods that fail to meet specifications can be returned to LOOTZ by the Buyer.
  3. Electronic products listed on the Platform are entitled to the warranty period stated during the listing. The terms and conditions of the warranty for electronic products are as described in the listing information.
